Imprint requirements in Switzerland and Germany

In Switzerland, the Federal Act against Unfair Competition (UWG) requires web shops and commercial websites to state their identity clearly: name or company, address and a direct contact option such as email. Registered companies must also include their UID number.

In Germany, the obligation goes further: under Section 5 DDG (formerly TMG), business websites must state, among other things, the full name, a serviceable address, an email address, the VAT identification number where applicable and, for editorial content, a responsible person under Section 18 (2) MStV. Missing details are a frequent reason for formal legal warnings (Abmahnungen) in Germany — the costs far exceed the effort of getting the imprint right.

What happens without an imprint?

In Germany, competitors or associations can issue formal legal warnings (Abmahnungen) that come with significant costs. In Switzerland, a missing imprint can constitute a violation of the UWG.

Does my private address have to appear in the imprint?

It must be a serviceable address — a PO box alone is not sufficient in Germany. If you do not want to show your home address, you can use a business address or an office service.
